Studio/Photographer: Mark Dorsey Jr, a California business (“Photographer”)
Client: The person or entity booking the session (“Client”)
• Retainer / Deposit (Non-Refundable): A retainer of 30% of the total session fee is required to reserve the session date/time. The retainer is non-refundable and is applied to the session fee.
• Balance: The remaining 70% is due before final delivery.
• Payment Methods: Cash, Card, Zelle, ACH, Venmo, or PayPal (+3% fee if applicable).
• Session Includes: 1 look, unlimited lighting setups, and 2 retouched images.
• Rescheduling Window: Client may reschedule once without penalty with at least 72 hours’ notice; shorter notice forfeits the retainer or incurs a reschedule fee of $25.
• Client Cancellation: If Client cancels the session (for any reason), the retainer is forfeited.
• No-Show / Late Arrival: Arrivals more than 20 minutes late may reduce shooting time or be treated as a no-show; no-shows forfeit the retainer.
• Photographer Cancellation / Illness / Force Majeure: If Photographer cannot perform due to illness, emergency, or events beyond reasonable control, Client may reschedule without penalty or receive a refund of fees paid (excluding services already rendered).
• Proofing Gallery: Proofs are delivered within 2 business days to a private, watermarked gallery.
• Final Retouched Files: Delivered within 3 business days after Client selects images and settles the balance.
• Rush Option: Rush delivery, if available, is +$50.
• Included Retouching: Session includes 2 retouched images at the standard retouching level.
• Additional Looks: Additional looks beyond the one included are $25 per look.
• Revisions: 1 reasonable revision per selected image; extra revisions billed at $10 per round.
• RAW/Unedited Files: RAW or unedited images are not provided.
• Copyright: All photographs are owned by Photographer under U.S. copyright law.
• Client License (Personal/Professional Use): Upon full payment, Photographer grants Client a non-exclusive, non-transferable license to use delivered images for personal branding, casting submissions, professional profiles (e.g., LinkedIn), personal websites, and social media with credit to Photographer where customary.
• Commercial Use: Commercial advertising by third parties (e.g., brands, agencies, or publications) requires a separate written license.
• Grant of Permission: Client irrevocably grants Photographer and assigns the right to use Client’s name, likeness, and photographs from the session in Photographer’s advertising and marketing, including but not limited to website, portfolio, social media, studio samples, online galleries, printed brochures, and displays, without additional compensation.
• Publicity Rights (California): Client acknowledges this is consent under California Civil Code §3344 for commercial use of likeness in Photographer’s self-promotion.
• Opt-Out: Client may opt-out of promotional use before the session by emailing [address]. Opting out may carry a 15% fee due to reduced portfolio value.
• HMUA: If booked via Photographer, HMUA fees are non-refundable once scheduled; one reschedule allowed with timely notice.
• Allergies/Preferences: Client must disclose allergies or product restrictions in writing before the session.
• Client agrees to arrive camera-ready, follow studio guidelines, and disclose any accommodation needs in advance.
• No illegal or hazardous items on set. Photographer may stop the session for unsafe or inappropriate behavior.
Photographer retains discretion over locations, lighting, and poses. Final image selection and editing style are at Photographer’s artistic judgment—consistent with the portfolio the Client reviewed.
Reshoots for technical errors attributable to Photographer are at Photographer’s discretion and at no additional charge. Changes due to Client preference (e.g., new haircut, beard, makeup, or wardrobe) are considered a new session.
Photographer keeps client files for 36 months after delivery; archiving beyond that is not guaranteed. Re-delivery or re-exports incur a fee of $15 per image.
Photographer’s liability is limited to the total fees paid for the session. Photographer is not liable for indirect or consequential damages. Client warrants they have authority to enter this agreement and to use the images as licensed.
A parent or legal guardian must sign for clients under 18 and be present at the session.
This Agreement is governed by the laws of the State of California. Parties will attempt to resolve disputes in good faith within 30 days. Venue: Courts of Los Angeles County, California shall have exclusive jurisdiction.
This Agreement (plus any signed estimate/invoice) is the entire understanding and supersedes prior discussions. If any part is unenforceable, the remainder stays in effect. Notices to: [email address] / [business address].
• Recording Disclosure: For quality assurance, training, safety, and documentation purposes, the Photographer may video and/or audio record all photo sessions within the studio or on location.
• Consent: By participating in the session, Client acknowledges and consents to being recorded and understands that such recordings may capture both video and sound during the shoot.
• Usage: These recordings are for internal use only unless the Client provides written consent for any portion to be used for marketing, behind-the-scenes, or educational purposes.
• Confidentiality: All recordings remain the property of the Photographer and will be stored securely. Recordings are not shared publicly without Client’s written permission, except as required by law.

By booking a session with Madhouse Photography, the Client acknowledges that they have read, understood, and agreed to all of the terms and conditions outlined in this agreement. Booking a session with Madhouse Photography constitutes full acceptance of these Terms & Conditions, including all policies regarding payments, cancellations, image usage, and video/audio recordings.
